Avoid L&I AIU Violations for Failing to Provide Contractor and Subcontractor Information
The BIA met with members of L&I’s Audits and Investigations Unit (AIU) to discuss members’ questions and concerns about violation notices and fines for failing to provide contractor and subcontractor information. AIU provided the following clarifications and recommendations:
Looking for people who are willfully attempting to avoid identification.
AIU requests for more information are sent in response to random audits and referrals.
If AIU does not see any subcontractor information in the file, they send a request. An AIU request is typically not sent if there is any subcontractor information is in the system.
If work has started and subcontractors onsite are not in eCLIPSE, AIU can issue a violation.
Failure to respond to a request is another violation.
AIU can withhold permits but should not hold up inspections; inspectors are not aware of AIU holds.
If a member feels a violation is issued in error, AIU encourages the member to appeal.
Once an appeal is filed, any action that may have taken place is on hold.
The recommended best practice is to have an administrative person add the subcontractor to eCLIPSE immediately, every time a contract is finalized. If there is a change in subcontractor for any reason, add the new subcontractor to eCLIPSE as soon as possible; don’t remove any subcontractors.
